CCW on Amtrak

Soon, I will be taking the train from one end of North Dakota to the other. I have a North Dakota carry permit. One of Amtrak's policies is that no firearms are allowed aboard the train. Is this legal? If I am in a state where I can legally carry a concealed weapon, can a company legally say that firearms are a no-no?

Do you really care? No metal detectors = carry. (CCW or not)

Seems simple enough to me.

I know what I'm going to do, and I feel quite safe and secure in that decision.

I was just wondering about the legality of it all. Can they legally prohibit firearms onboard?

I've traveled armed on Amtrak in California several times in the past fourteen years. I've never noticed any active anti-gun measures.

I suppose the worst they can do is put you off the train.

Fuggem. Do they take full responsibility for your welfare on the train, could your next of kin sue 'em and win if they failed in that?...yea, thats what I thought.

It is a felony to carry a firearm on an Amtrac train. The same section of the law applies on trains that applies on commercial aircraft (27CFR178.31). Firearms may be transported, but they must be declared and be in checked baggage. Even if you don't cross a state line, Amtrac is an interstate carrier. Compliance is up to your acceptance of the risks.

About 10 years ago on a train on Long Island, N.Y. the only person onboard carying a handgun (illegally) was Colin Ferguson. He killed nine unarmed individuals before he was stopped. He was tackled while reloading. A legal CCW holder onboard may have been able to put an end to Ferguson before he killed so many, but we all know that it is next to impossible to get a CCW permit in the N.Y.C. area. Something to think about.
