If the penalty for all violence was being taken to a concentration camp and tortured to death it wouldn't matter who has guns because everyone but the mentally ill would be too afraid to commit crimes. Let's just go ahead and get rid of those Fifth, Sixth, and Eighth Amendments while we're ignoring the Constitution here."
